These Terms & Conditions (the "Terms") are a legal agreement between you (the "Customer", "you")
and Shree Malikarjun Adventure Pvt. Ltd. ("we", "us", "our").
By using our website, submitting an inquiry, or booking any trip, you confirm that you have read,
understood, and agree to be bound by these Terms.
1) Eligibility & Website Use
- You must be at least 18 years old (or have consent of a legal guardian) to make a booking.
- You agree to provide accurate, current information in all forms and communications.
- Use of this website for unlawful or unauthorized purposes is strictly prohibited.
2) Our Services
We arrange and operate trekking, hiking, sightseeing, cultural, and adventure experiences in Nepal.
The exact inclusions, exclusions, and itinerary for a specific trip will be set out in your confirmation
email/itinerary and any service description on our website at the time of booking.
3) Bookings & Payments
- Inquiry & Quote: After you submit an inquiry, we will provide a tailored proposal with pricing, inclusions, availability, and dates.
- Booking Confirmation: A booking is confirmed once you accept our proposal and we confirm availability in writing.
- Deposit (when required): For certain trips (e.g., peak season, permits, domestic flights, or limited availability), we may require a deposit to secure reservations. If a deposit is required, the amount, deadline, and payment method will be stated in your proposal. Deposits are typically paid by bank transfer or cash in Nepal, as agreed in writing.
- Remaining Balance: Unless otherwise stated in your proposal, the remaining balance is paid in Nepal prior to the trip start (usually on arrival / during the pre-trip briefing).
- Payment Methods: We currently accept bank transfer and cash in Nepal. We do not offer online card payments unless explicitly stated.
- Currency: Prices are shown in USD unless otherwise indicated. Bank charges and foreign exchange fees are your responsibility.
- Pricing Errors: We reserve the right to correct any pricing or typographical errors and, where necessary, offer you the option to proceed at the correct price or cancel with a refund of any amounts paid.
4) Cancellation & Refunds
If you cancel, the following applies (unless your specific proposal/booking confirmation states otherwise):

If no deposit was paid:
You may cancel free of charge. However, you are responsible for any
non-recoverable supplier costs we have already paid or committed on your behalf
(e.g., permits, domestic flights, pre-booked accommodation/transport). Where available, we will provide
receipts or supplier confirmations.

If a deposit was paid:
Deposits are generally non-refundable once permits/transport/accommodation have been confirmed,
and you may also be charged for any additional non-recoverable supplier costs paid on your behalf.
If we can recover any costs from suppliers, we will refund the recoverable amount.

Late cancellation / no-show:
If you cancel 14 days or fewer before the trip start date, or you do not show up,
you may be charged up to 100% of the non-recoverable costs we have already committed or paid
to suppliers.

If we cancel:
If we cancel due to insufficient bookings, safety concerns, or events covered under Force Majeure,
we will offer either (a) a transfer to a new date, or (b) a refund of recoverable amounts paid.
We are not liable for incidental or personal expenses (e.g., visas, vaccinations, travel insurance, gear,
or third-party flights).
Definition: “Non-recoverable supplier costs” means amounts that suppliers do not refund to us
(or only refund partially) after services have been booked/issued.
5) Changes & Itinerary Flexibility
- Your changes: We will try to accommodate change requests; additional costs may apply.
- Our changes: Due to mountain weather, trail conditions, health/safety, or government restrictions, we may adjust accommodations, routes, or schedules. Equivalent or higher standard substitutions may be made when possible.
6) Travel Documents & Permits
You are responsible for valid passports, visas, permits (e.g., TIMS, National Park/Conservation permits),
vaccinations, and compliance with local regulations. We can assist with guidance but final responsibility
remains with you.
7) Assumption of Risk & Safety
Adventure activities involve inherent risks including altitude sickness, weather events, landslides,
illness, and remote rescue limitations. By participating, you acknowledge and accept these risks and agree
to follow guide instructions and safety briefings at all times.
8) Health, Fitness & Insurance
- You must disclose relevant medical conditions and ensure you are fit for your chosen itinerary.
- Mandatory: Comprehensive travel insurance covering medical, evacuation, and trip cancellation/interruption for the full trip duration.
- We may decline participation or remove a participant if their condition poses a risk to themselves or others.
9) Force Majeure
We are not liable for delays, itinerary changes, or cancellations caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, epidemics/pandemics, war, civil unrest, strikes, government actions, border closures, or infrastructure/transport failures. In such cases, any refund will be limited to recoverable amounts we are able to obtain from suppliers (e.g., airlines, hotels, transport providers, or permit offices). We are not responsible for incidental or personal expenses (e.g., visas, vaccinations, travel insurance, gear, or third-party flights).
10) Participant Conduct
- Show respect for local culture, wildlife, and the environment; comply with Leave No Trace principles.
- Follow guide instructions. We may dismiss participants for dangerous, illegal, or disruptive behavior without refund.
11) Inclusions & Exclusions
Your confirmation will specify what is included. Unless stated otherwise, prices typically exclude
international flights, personal equipment, travel insurance, personal expenses, tips, and meals not
indicated in the itinerary.
12) Third‑Party Suppliers
We may use independent suppliers for transportation, accommodation, or activities. Their own terms and
policies may apply in addition to ours.
13) Intellectual Property
Website content (text, images, logos, layouts, and code) is owned by us or licensed to us and protected by
intellectual property laws. You may not copy, distribute, or create derivative works without prior written permission.
14) User Content & Reviews
By submitting testimonials, photos, or reviews, you grant us a non‑exclusive, royalty‑free license to use
and display such content for marketing and promotional purposes, unless you explicitly opt out in writing.
15) Privacy
Your personal data is handled in accordance with our Privacy Policy.
16) Disclaimers & Limitation of Liability
- Except as required by law, our services are provided "as is" without warranties of any kind.
- To the maximum extent permitted by law, our total liability arising from or related to your trip is limited to the amounts you paid to us for the affected services.
- We are not liable for indirect, incidental, special, or consequential losses (including lost profits, missed connections, or additional accommodation costs).
17) Indemnity
You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your breach of
these Terms or your misconduct during a trip.
18) Third‑Party Links
Our website may include links to third‑party sites we do not control. We are not responsible for their
content, policies, or practices.
19) Updates to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with the
"Last updated" date revised accordingly. Continued use of the website or services after changes constitutes acceptance.
20) Governing Law & Dispute Resolution
These Terms are governed by the laws of Nepal. Any disputes shall be subject to the
exclusive jurisdiction of the courts of Kathmandu District Court, Nepal.
